Acceptable Use Policy

01Overview

This Acceptable Use Policy ("AUP") describes what is and is not allowed on the SwiftShift platform. It applies to everyone who uses SwiftShift — restaurants, workers, and visitors to the website. This AUP supplements our Terms of Service and is incorporated into it by reference.

SwiftShift exists to make hospitality work fair, fast, and safe for both sides of the shift. We enforce this AUP strictly.

Allowed
  • Posting genuine, lawful shift listings at a real food service establishment
  • Applying for shifts that match your skills and availability
  • Honest ratings and reviews based on actual experience
  • Polite, professional in-app communication
  • Reporting other users who violate this AUP
Not allowed
  • Fake listings, fake profiles, fake reviews
  • Working or paying off-platform after meeting through SwiftShift
  • Harassment, discrimination, or threats toward any user
  • Posting shifts at sub-minimum-wage rates
  • Sharing accounts, scraping data, or abusing the platform

03Prohibited Content and Activity

Fraudulent or Deceptive Conduct

  • Creating fake accounts, fake worker profiles, or fake restaurant listings
  • Misrepresenting your identity, qualifications, work history, or business
  • Posting "ghost" shifts that you don't intend to fill
  • Inflating, faking, or trading ratings and reviews
  • Using stolen or fraudulent payment methods

Off-Platform Circumvention

  • Soliciting or accepting payment for a SwiftShift-introduced shift outside the SwiftShift payment system
  • Directing a worker or restaurant you met on SwiftShift to a competing platform or to a private arrangement to avoid the service fee
  • Sharing personal contact info inside the app for the purpose of working off-platform

This is the fastest way to be permanently removed. SwiftShift may also seek a clawback of unpaid service fees.

Harassment, Discrimination, and Safety

  • Threatening, intimidating, or stalking another user
  • Harassment or unwanted contact, including via in-app messaging or after a shift ends
  • Discrimination on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, pregnancy, veteran status, or any other protected class
  • Hate speech, slurs, or content advocating violence
  • Posting shift requirements that exclude or screen workers based on protected characteristics

Illegal Activity

  • Any conduct that violates federal, state, or local law
  • Posting shifts that violate minimum wage, child labor, or working-hour laws
  • Posting shifts for unlicensed alcohol service, cash-only "under the table" work, or other unlawful arrangements
  • Using the platform to traffic, exploit, or coerce another person

Platform Abuse

  • Sharing account credentials with another person or entity
  • Creating multiple accounts to evade suspensions or game ratings
  • Scraping, copying, or harvesting data from the platform
  • Attempting to access another user's account or non-public parts of the platform
  • Reverse-engineering the app, probing for vulnerabilities, or interfering with platform infrastructure
  • Sending spam, phishing attempts, or malware to other users

Inappropriate Workplace Behavior

  • Showing up for a shift visibly intoxicated or impaired
  • Theft, vandalism, or property damage at a restaurant during a shift
  • Sexual harassment of any kind
  • Refusing reasonable safety instructions from the restaurant during a shift

04Reporting Violations

If you experience or witness a violation of this AUP, report it immediately:

  • Inside the app: Use the "Report" option on a user profile or shift listing
  • By email: support@swiftshiftapp.com with the subject line "AUP Violation Report"
  • Emergency: If you are in immediate danger, contact local emergency services (911) first, then report to us

Reports are confidential to the extent allowed by law. We do not tolerate retaliation against users who report in good faith.

05Enforcement

Depending on the severity and frequency of a violation, SwiftShift may take any of the following actions, with or without prior notice:

  • Issue a written warning
  • Suspend the account temporarily (e.g. 72 hours for first cancellation/withdrawal offenses — see Terms §7)
  • Remove the offending content (listing, message, rating)
  • Permanently remove the account from the platform
  • Withhold payouts pending investigation, where allowed by law
  • Report to law enforcement or regulatory authorities
  • Seek legal remedies, including recovery of unpaid service fees from off-platform circumvention

SwiftShift exercises its enforcement discretion in good faith. We do not guarantee specific actions in specific cases, and we may decline to act on reports that lack sufficient information.

Permanent removal is generally final. Reinstatement requests may be submitted to support@swiftshiftapp.com and are reviewed at SwiftShift's sole discretion.

06Changes to This Policy

SwiftShift may update this AUP at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the platform after the effective date constitutes acceptance.
